San Diego Border Patrol agent accused of murder

New information on the Valerie Munique Tachiquin Alvarado case

The family attorney of Valerie, Gene Iredale filed a lawsuit yesterday, not only against the agent responsible for her death, but also against the Border Patrol department of San Diego, claiming that the department knew of certain incidents and did nothing about it.

This is not the first incident in which Justin Tackett is accused of using unnecessary force; there have been three other incidents in which the causes are not known.

Last month the U.S. border patrol agent Justin Tackett, who shot and killed Valerie Alvarado, was suspended for the fourth time in a period of four years, and then resigned from his job.

The Chula Vista Police Department is still investigating the events that occurred on September 28th.

Agents say that Tackett ordered the women to stop, who then hit him with her vehicle, and another agent who was present at the scene, said that they began to shoot because Tackett feared for his life.

Tackett has refused to comment about the incident, and his name was only obtained due to the lawsuit that was filed, which both the Chula Vista Police Department and the Border Patrol had previously declined to release the 34 year old agents name.

The agents had gone to Moss Street to arrest a convict that had been deported before, because of a long history of crimes related to drug charges.

The San Diego court also revealed that Alvarado also had a long criminal history, which included possession of methamphetamines in 2004, and was on probation for possession of narcotics.

The Alvarado family expressed their unconformity with the investigation, and the widower of the victim, Gilbert Alvarado is outraged of what happened and said to NBC 7 news "My wife was murdered for no reason, show me that my wife had a weapon or put this man's life in danger to the extent where he had to use deadly force.

Where is the evidence that threatened an armed officer? I want justice".

To the CBS channel her father said, "I want to know why?" Valentin Tachiquin sadly continued to speak about the death of his daughter. "What made the border patrol agent shoot several times", my family wants answers and we are looking for justice.

Iredale said that the agent fired nine times at the victim, and there are some witnesses that say that the agent kept on firing as he walked up to her car, and others say that they saw the agent right in front of the hood of the car as he kept on shooting.

Shawn Moran, who is the vice president of the border patrol union, said that the agent did the right thing.

"No agent takes it lightly when being involved in a shooting where a person dies, if the agent said that his life was in danger and it was necessary to use lethal force, we are going to support him and accept his statement.

I'm sure that Ms. Iredale will sue, but our union will defend an agent when this happens".

On her behalf, Iredale states about the agent "that he was involved in mistakes after mistakes, bad behavior after bad behavior, and he should have never been hired by the border patrol".

The lawsuit for wrongful death and the use of excessive force against Tackett and the department, was presented with the names of the victim's father, husband and five children.

The Border Patrol Department has six months to file an answer, and after that the family can continue to take legal actions against the department and file a civil case.
